We give no guarantee, warranty or representation that any proposed development will receive approval, nor that the likelihood percentages or recommendations in any Report are accurate or complete.

Ordering Reports and Payments

Prices are displayed on the Website in Australian dollars and are exclusive of GST unless otherwise stated. GST will be calculated and added at checkout where applicable. We may change our prices at any time. Price changes do not affect Reports already purchased.

Payments are processed through Stripe, our secure third-party payment provider. You authorise us to charge the payment method you provide.

Once a Report has been generated and delivered (or made available for download), the transaction is final and non-refundable except where required by the Australian Consumer Law ("ACL") or other applicable law. Reports will be delivered electronically, once payment has been received by us.

Privacy

We respect your privacy and set out our obligations in our Privacy Policy. We are also bound by the legal requirements of the Australian Privacy Principles as set out in the Privacy Act 1988 (Cth) and any other applicable legislation. Our Privacy Policy forms part of these Terms.

Accuracy of Your Instructions

To the maximum extent permitted by law, we and our directors, officers, employees, agents and contractors will not be liable to you for any loss or damage whatsoever (including direct, indirect, consequential, incidental, special, punitive or exemplary loss or damage, loss of profits, loss of opportunity, loss of data, loss of reputation, or reliance on any Report), arising out of or in connection with your access to, use of, or reliance on the Website or any Report, whether based in contract, tort (including negligence), statute or otherwise, and even if we were advised of the possibility of such loss.

Our total aggregate liability to you for any claim will not exceed the amount actually paid by you for the relevant Reports in the 12 months preceding the claim.

Nothing in these Terms excludes, restricts or modifies any liability that cannot be lawfully excluded under the Australian Consumer Law or other applicable law. This clause survives termination of these Terms or any licence granted under them.

Account Login

Upon your request, we may issue a login ID and password to you to access our Website and the Services. Your use of a login ID and password constitutes your agreement with all policies, standards and procedures that may be issued by us from time to time with respect to the use of your login ID and password. You further agree that it is your responsibility to take necessary precautions to ensure that your login ID and password are kept confidential. We reserve the right to deactivate any login ID and password which has been inactive for 90 days, or if you have violated any of the Policies, or if you have failed to pay charges when due to us.

These Terms and the resolution of any dispute related to this agreement or access to or use of this website and the information, products and services obtained through this website are governed by the laws of New South Wales and both we and you submit to the non-exclusive jurisdiction of the courts of that state.
